These public terms describe how to use the Climakers website, documentation, checkout flows, and customer-operated software offerings.

Climakers provides public information about its products, documentation, and purchasing flows, while the use of specific software releases remains subject to the product-specific license terms published with each tool.

Public site and documentation

The Climakers public site and docs are provided so customers can evaluate products, learn workflows, and access support and licensing information.

Product-specific licenses still govern software use

The website does not replace the license terms for acp2md, acs2md, or later tools. Each product remains governed by its own published license and checkout terms.

Customer-operated responsibility

Customers remain responsible for how they deploy, configure, secure, and operate Climakers tools inside their own environments and compliance programs.

Operating principles

The public terms are intentionally aligned with how Climakers products are designed and sold.

Use the site lawfully

Do not use the site, documentation, or purchase flows to interfere with operations, attempt abuse, or violate applicable law or contractual restrictions.

Follow the published licenses

When you buy or operate a Climakers tool, the applicable product license, support scope, and checkout terms control the use of that specific software.

Respect ownership and branding

Climakers names, logos, documentation, product content, and site materials remain protected intellectual property except where a separate license or permission says otherwise.

No warranty

The public site and documentation are provided "as is" and "as available". Climakers disclaims, to the fullest extent permitted by law, all express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

Climakers is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, and total cumulative liability arising under these public terms is capped at USD 100. Product-license terms govern any liability position for the software itself.

Indemnification

You agree to defend, indemnify, and hold Climakers harmless from claims, damages, costs, and fees arising out of your misuse of the public site, your violation of these terms, or your violation of applicable law or third-party rights.

Termination of access

Climakers may suspend or terminate access to the public site at any time, with or without notice, for conduct that Climakers reasonably believes violates these terms or is harmful to other users, to Climakers, or to third parties.

Governing law and disputes

These public terms are governed by applicable law without regard to its conflict-of-laws provisions, and the parties will attempt good-faith negotiation before pursuing other remedies. Mandatory consumer-protection rights in your jurisdiction are not limited.

Standard provisions

Severability, entire agreement with the privacy and security policies and product licenses, assignment, force majeure, age and authority to contract, export-control compliance, and English as the controlling version of these terms.

1. Scope

These Terms of Use apply to the Climakers public website, public documentation, public pricing and product pages, and related purchase or contact flows made available through the public site.

These public terms do not replace the product-specific software license terms that apply to acp2md, acs2md, or future Climakers tools. If you use a specific product, the applicable product license and checkout terms continue to govern that software.

2. Acceptable use

You may use the public site and public documentation to evaluate products, understand workflows, review pricing, access support routes, and complete legitimate purchase or support interactions.

You may not use the site or related services to disrupt operations, probe for abuse, misrepresent your identity, interfere with other users, or violate applicable law, third-party rights, or contractual obligations.

3. Purchases, product licenses, and external services

Climakers may use hosted checkout or payment providers for public purchases. Product purchases, billing, and tax handling may therefore involve third-party commerce services, including a merchant-of-record arrangement, in addition to the Climakers site itself.

Use of Climakers software is governed by the product-specific license terms published with the documentation, including but not limited to the acp2md license terms at https://docs.climakers.com/acp2md/v1.0.0/license-terms and the acs2md license terms at https://docs.climakers.com/acs2md/v1.0.0/license-terms. Customers are responsible for reviewing the applicable product license, pricing, and operational requirements before purchase or deployment, and the product-specific license terms control the use of that specific software.

4. Ownership, content, and customer responsibility

Climakers retains rights in the public site, product branding, logos, written materials, documentation structure, and other public content except where a separate license or permission clearly states otherwise.

Customers remain responsible for how they configure, secure, and operate Climakers tools inside their own environments, including credential handling, access control, exports, compliance decisions, and internal approvals.

5. No warranty

THE CLIMAKERS PUBLIC SITE, DOCUMENTATION, AND PURCHASE FLOWS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CLIMAKERS DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NONINFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

Climakers does not warrant that the public site or documentation will be uninterrupted, error-free, or free of harmful components, that defects will be corrected, or that the information presented is accurate, complete, or current at any given moment. The product-specific license terms govern any warranty position for Climakers software itself.

6. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL CLIMAKERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, BUSINESS, USE, DATA, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE PUBLIC SITE OR DOCUMENTATION, EVEN IF CLIMAKERS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL CUMULATIVE LIABILITY OF CLIMAKERS ARISING OUT OF OR RELATED TO THESE PUBLIC TERMS WILL NOT EXCEED ONE HUNDRED UNITED STATES DOLLARS (USD 100). LIABILITY ARISING UNDER A SPECIFIC PRODUCT LICENSE IS GOVERNED BY THAT PRODUCT'S LICENSE TERMS AND IS NOT EXPANDED OR ALTERED BY THESE PUBLIC TERMS.

7. Indemnification and termination

You agree to defend, indemnify, and hold Climakers harmless from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the public site or documentation in violation of these terms, your violation of applicable law, or your violation of any third-party right.

Climakers may suspend or terminate your access to the public site or documentation at any time, with or without notice, for conduct that Climakers reasonably believes violates these terms or is harmful to other users, to Climakers, or to third parties. Provisions that by their nature should survive termination — including ownership, warranty disclaimer, limitation of liability, indemnification, governing law, and the standard provisions section — will survive.

8. Governing law and standard provisions

These public terms are governed by applicable law without regard to its conflict-of-laws provisions. The parties will attempt to resolve disputes through good-faith negotiation before pursuing other remedies. Nothing in these terms limits any right that cannot be limited under applicable consumer-protection law in the user's jurisdiction. The product-specific license terms may set different dispute and governing-law provisions for use of the software, and those provisions will control for matters falling within their scope.

If any provision of these terms is held to be unenforceable, the remaining provisions will remain in full force and effect. These terms, together with the product-specific license terms, the privacy policy, and the security policy, constitute the entire agreement between the parties relating to the public site. Climakers may assign these terms in connection with a merger, acquisition, or sale of assets; users may not assign these terms without Climakers's prior written consent. Neither party will be liable for delay or failure to perform caused by events beyond reasonable control. Use of the public site requires legal capacity to enter into a contract under applicable law; users acting on behalf of an organization represent that they have authority to bind that organization. Use of the public site, documentation, and Climakers software is subject to applicable export-control and sanctions laws, and users are responsible for compliance in their jurisdiction. The English version of these terms is the controlling version; translations are provided for convenience.

9. Changes and contact

Climakers may update these public Terms of Use as products, site features, documentation, purchasing flows, or legal requirements evolve. The effective date at the top of this page identifies the latest published version.
